1. Use of the Website

HomeMapr is an online property platform that allows users, property owners, landlords, sellers, developers, estate agents, service providers, and other authorised users to create, upload, publish, promote, browse, enquire about, and interact with property listings.

You may only use the website for lawful purposes and in accordance with these Terms.

You agree not to:

• upload false, misleading, fraudulent, offensive, illegal, or unauthorised listings;
• impersonate another person or business;
• upload content that infringes third-party rights;
• interfere with the website's operation, security, or availability;
• scrape, copy, harvest, or misuse data from the website without written permission;
• use the website for spam, unlawful marketing, scams, or fraudulent property activity.

2. User Accounts

To upload listings or use certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

• provide accurate, current, and complete information when registering;
• update your information if it changes;
• notify us immediately of any unauthorised use of your account;
• not share your account credentials with any third party.

3. Property Listings

Users who upload property listings warrant that they are the owner of the property, a duly authorised agent, or have the legal right to advertise the property.

All listings must:

• accurately describe the property, including price, location, size, and condition;
• not contain false, misleading, or deceptive information;
• comply with all applicable laws, including the Consumer Protection Act and the Estate Agency Affairs Act;
• not infringe any third-party intellectual property rights.

4. Enquiries and Communications

When you submit an enquiry about a property, your contact information and message may be shared with the listing agent, seller, or landlord. HomeMapr is not a party to any transaction or agreement between buyers, sellers, tenants, landlords, or agents.

HomeMapr does not guarantee the accuracy of any information provided by third parties on the platform and is not responsible for the conduct of any user.

5. Payments and Subscriptions

Certain features on HomeMapr (such as premium listings or advertising packages) may require payment. All fees are quoted in South African Rand (ZAR) and are inclusive of VAT unless stated otherwise.

Payments are processed via secure third-party payment providers. HomeMapr does not store your card details. All sales are final unless otherwise stated in writing.

HomeMapr reserves the right to change its pricing and subscription plans at any time with reasonable notice.

6. Intellectual Property

All content on HomeMapr — including the brand name, logo, website design, code, graphics, text, and compiled data — is the intellectual property of LNS Corporation (Pty) Ltd or its licensors and is protected under South African and international copyright law.

By uploading content (including photos, descriptions, or documents) to HomeMapr, you grant HomeMapr a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform.

You retain ownership of content you upload. You warrant that you have the right to grant this licence and that your content does not infringe any third-party rights.

7. Privacy

Your use of HomeMapr is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection and use of your personal information as described in that policy.

8. Disclaimers and Limitation of Liability

HomeMapr provides its platform on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

HomeMapr expressly disclaims liability for:

• the accuracy, completeness, or legality of any listing or user-submitted content;
• any transaction, agreement, or dispute between users;
• loss of data, revenue, or profits arising from use of the platform;
• any reliance placed on information published on the website.

9. Third-Party Content and Links

HomeMapr may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of any third-party site. The inclusion of a link does not constitute an endorsement by HomeMapr.

10. Termination

HomeMapr may, at its sole discretion and without prior notice, suspend or permanently terminate your access to the platform if you breach these Terms, engage in fraudulent or harmful conduct, or for any other reason we deem appropriate.

You may close your account at any time by contacting us at info@homemapr.com. Termination does not affect any rights or obligations that arose before the date of termination.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.

12. Changes to These Terms

HomeMapr reserves the right to update or amend these Terms and Conditions at any time. We will notify users of material changes by posting the revised Terms on this page with an updated "Last updated" date. Continued use of the platform after such changes constitutes your acceptance of the new Terms.
